During
the course of a divorce, end of a relationship, or other
domestic situation, circumstances sometimes arise which
causes and individual to fear for the safety of their
children or themselves.
An order of protection, also commonly called a
restraining order or domestic injunction, is a
court order typically ordered due to domestic violence,
repeated violent acts or threats, date violence, or sexual
violence.
Basic elements necessary for a domestic protective order:
1) Must be between family or household members, 2) The
Petitioner must claim to have been the victim of domestic
violence or is in fear of imminent attack, 3) The sworn
petition shall allege the existence of such domestic
violence and shall include the specific facts and
circumstances, 4) Jurisdiction is where the Petitioner
currently resides, temporarily resides; where Respondent
resides, and where domestic violence occurred.

A domestic injunction, or order of
protection, serves two main purposes. 1) to inform the
recipient of the restraining order of the legal restrictions
which have been ordered against them regarding to individual
or individuals who the protective order was granted,
2) to provide legal documentation and protection for the
individual or individuals who have been granted a
domestic injunction.
According to Florida Statutes, Domestic violence
means an assault, aggravated assault, battery, aggravated
battery, sexual assault, sexual battery, stalking,
aggravated stalking, kidnapping or false imprisonment, or
any criminal offense resulting in physical injury or death
to any family or household member by another who is or was
residing in the same single dwelling unit.
Family or household member includes spouses, former spouses,
persons related by blood or marriage, persons who are
presently residing together as if a family or who have
resided together in the past as if a family, and persons who
have a child in common regardless of whether they have been
married or have resided together at any time.
