Child
support,
as with any family law issue, can be very
complicated, and are best represented with the
assistance and guidance of an experienced child
support attorney & lawyer. Child
support cases should also be handled in a
delicate manner, and with the utmost discretion
regarding the child, or children.
Child Support
is payment from one spouse to another for the support of
the children following a divorce, or the break-up of an
unmarried couple. Normally, child support payments end
when a child turns 18 years old or until the child graduates
high school if prior to the 19th birthday.
Child support
cannot be discharged in bankruptcy and is not considered as
income by the receiving parent, nor considered a tax deduction
by the paying parent.

The amount of child support that a parent pays is
determined by the Child Support Guidelines. When
calculating the proper child support to be paid, there
are a number of factors to consider that affects the child
support that is ordered by the court. Some of those issues
include, but are not limited to:
-
The amount of overnights that each parent has the child;
-
The financial needs of the child such as day care expenses,
medical / dental insurance, uninsured medical payments;
-
And the current income of both parents.
In the event that circumstances with either parent significantly
changes, which may warrant a post judgment child support
modification, either parent may file for a modification
hearing to change the existing
child support
court order. Modification requests are not typically well
received by the other parent, and are typically heavily
disputed.
