Criminal Assault
A criminal offense of assault occurs when one person
makes a willful attempt or threat to injure someone else, and
also has an apparent, present ability to carry out the threat
such as by flourishing or pointing a dangerous weapon or device
at the other. An assault may be committed without
actually striking or injuring another person. Assaults are
either simple or aggravated.

A simple assault is limited to the threat of physical
force and result in little or no injury to the victim. This
is punished by a fine and/or imprisonment.

An aggravated assault is a threat to cause great
bodily harm or is committed with the use of a deadly weapon,
and they are more severely punished than simple assaults.
Criminal Battery
Criminal battery
is the unlawful touching of an individual by another. Unlike an
assault, there is actual contact. This may include a physical
act of spitting in another's face, any form of unwanted
intentional touching in anger, or jostling of another.
However, if the physical contact is proved to be incidental and
unintentional, or conducted while defending one's self or others
against a perceived threat of physical harm, this is not
considered criminal battery, and is a viable defense if
charged.
